Engexpor – Consultores de Engenharia S.A. (hereinafter referred to as “Engexpor”), in the capacity of Controller, respects your privacy and undertakes to protect it. For such purpose, this Privacy Policy aims to inform all users of the website www.engexpor.com (hereinafter referred to as “website”) about the respective collection and processing practices for personal data and information, and about your rights in relation to these data and information, protected by the Personal Data Protection Law (Law No. 67/98, of October 26) and by Regulation (EU) 2016/679 of the European Parliament and of the Council (hereinafter referred to as “GDPR”)

3.1. For which purposes do we process your personal data?

The personal data collected through the form available via the website shall be processed for the following purposes:

organizing and managing the recruitment process, assessing the suitability of the candidate for the position or job in question and responding to applications from professionals;

compliance with legal obligations on equality and non-discrimination.

3.2. Which recipients will your personal data be disclosed to?

Engexpor hereby informs you that your personal data will only be accessed by the company’s Administrative and Financial Department.

Engexpor may hire third parties to provide logistical support or other administrative support. These parties may have access to personal data to the extent necessary to provide such services.

3.3. What is the legal basis for processing your personal data?

Your personal data, according to the purpose, shall be processed pursuant to the following legal grounds:

organizing and managing the recruitment process, assessing the suitability of the candidate for the position or job in question and responding to applications from professionals. Your personal data shall be processed in accordance with the (i) need for processing to perform a contract which the data subject is a party to or for pre-contractual formalities at the request of the data subject, and the (ii) need for processing for the purposes of the legitimate interests of the controller, specifically to check the suitability of the Candidate for the position available, which we understand shall be fully compatible with the Candidate’s interests.

For personal data processing to comply with legal obligations relating to equality and non-discrimination, the applicable legal basis will be compliance with the legal obligations that Engexpor is subject to.

3.4. How long do we  keep your personal data for?

The retention period for your personal data may vary in line with the applications submitted in a recruitment process or if they are unsolicited applications.

Your personal data will also be retained during the following periods:

Applications during a recruitment process:

The personal data of applicants will be retained during the recruitment process;

When selecting the candidate, their data will be retained for 5 years for the purposes of complying with the legal obligations imposed in relation to registering recruitment processes. The applicant’s data will also be retained for the purposes of the employment relationship, with the terms and periods defined for the employment relationship applying in the latter case;

If the candidate is not selected during the recruitment process:

Their personal data will be retained for a 1-year period after the recruitment process ends;

In any case, the Candidate’s personal data will be kept as strictly necessary for a 5-year period to comply with the legal obligations imposed in relation to registering recruitment processes and for the period necessary for the establishment, exercise or defense of legal claims.

Unsolicited applications:

The applicants’ personal data shall be retained for a 1-year period and used for recruitment processes commencing in this period. In this case, the above-mentioned time periods will apply.

3.5. What rights do you have?

Pursuant to applicable data protection law, you have the right to:

I. Request access to your personal data: You have the right to receive confirmation about whether any of your personal data are processed or not, and, if this is the case, request access to your personal data. Access information includes, among other things, the purposes of the processing, the categories of personal data in question and the categories of recipients or to whom your personal data were or will be disclosed.

You may have the right to obtain a copy of the personal data to be processed.

II. Request the rectification of your personal data: you have the right to ensure rectification of inaccuracies concerning your personal data. Considering the purposes of the processing, you have the right to ensure any incomplete personal data is completed, including through an additional declaration.

III. Request the deletion of your personal data: under certain circumstances, you may have the right to delete your personal data and we will be required to delete such personal data;

Engexpor uses technical and organizational security measures to protect against the unauthorized handling, loss, destruction or access of the data you provide and processed by Engexpor. The security measures taken are constantly enhanced in line with the latest technology.

For your convenience and information, the Engexpor “website” may provide “links” to external “sites”. Accessing these “links” means leaving the Engexpor website.

Engexpor does not control these websites in privacy policies, which may be different to this privacy policy.

Engexpor does not approve or represent these websites. The Engexpor Privacy Policy does not cover any personal data processing carried out by these websites external to Engexpor.
